Canadian Work Permit

Foreign nationals wishing to work in Canada on a temporary basis usually require a work permit. Two of the main programs through which work permits are issued are the Temporary Foreign Worker Program (TFWP) and the International Mobility Program (IMP). The TFWP offers work permits for candidates whose employers obtain a positive Labour Market Impact Assessment (LMIA). A positive LMIA confirms there is a need for a foreign worker to fill the job at hand and that no Canadian worker is available to do the job. IMP work permits do not require a positive LMIA. They do require the employer to submit an employment offer under their employer portal.

Work Permit Types

Canada issues two types of work permits: employer-specific work permits and open work permits. Employer-Specific Work Permit:  An employer-specific work permit includes conditions such as: (a) Name of a specific employer, (b) How long a candidate can work, (c) The location of a candidate’s work. Candidates applying for an employer-specific work permit must have from their employer a positive Labour Market Impact Assessment (LMIA) or an offer of employment before applying. Open Work Permit: An open work permit allows you to work for any employer in Canada, but they are issued only in specific circumstances.

STEPS TO GET CANADIAN WORK VISA

Canada Work Permit, or a Work Visa, is issued to eligible overseas individuals to work in Canada for a specific time period. There are 4 basic steps to getting a temporary Canadian Work Visa:

  • Employer applies for labour market opinion (if necessary)
  • Employer extends temporary job offer to foreign workers
  • Foreign skilled worker applies for work permit
  • Work permit is issued.

General Eligibility Requirements

  • Give proof that you will move out of Canada on the expiry of your Work Permit
  • Have documents showing that you have enough funds to support yourself during your stay in Canada
  • Have no record of any criminal activity and submit a police clearance certificate as proof
  • Are not a danger to Canada’s security
  • Must have good health and take a medical exam if required
  • Must be ready to provide any documents demanded by officers to qualify your entry to Canada

 

Documents Required to Apply for Work Visa

  • A valid passport with a validity of more than 6 months from the planned date of arrival in Canada.

In most cases, applicants will first require a job offer before they can apply for a Canadian work permit. In the vast majority of cases, the first step towards obtaining a Canadian work permit is to apply for a Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC).

In order to qualify for this status, you must be a skilled professional or trades-person with a certain amount of work experience. You don't have to have a job offer in order to apply to be a part of the Express Entry system.
As per the visitor visa conditions, a visitor is forbidden from seeking any paid employment offer in Canada. If a candidate has a travel visa, the only way to change it is to re-apply for the Canadian visa with a work permit.

If your spouse or common-law partner is a permanent resident, they can work in Canada. If your spouse or common-law partner is in Canada on a temporary resident (visitor) visa, they have to apply for a work permit to be able to work.

Frankly speaking, you can migrate to Canada without a job offer. Do keep in mind that while for most cases a job offer is not needed, you will require a valid job offer if your plan of immigration Canada involves going through either the Federal Skilled Worker Program (FSWP) or Federal Skilled Trades Program (FSTP).

Canadian employers can hire Express Entry candidates to meet their labour needs when they are not able to find Canadians or permanent residents to fill job vacancies. Employers can hire workers abroad or already in Canada.

If a Canadian citizen (or permanent resident) marries a foreign citizen and that citizen is at minimum 18 years old and is living with a Canadian citizen who is at minimum 18 years old in Canada, the spouse may apply for Spousal Sponsorship. The marriage must be legal in the country in which it was performed.

 Canadian citizens and permanent residents who live in Canada can apply to sponsor (bring) their family members to live with them in Canada. The sponsor must agree to support the person for three to 10 years.
